Terms of Service.

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and Boticelli Ventures LLC, doing business as Kima ("Kima," "we," "us," or "our"), for the Kima mobile app, website, waitlist, support, and related services (the "Service"). By creating an account, joining a household, joining the waitlist, or using the Service, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree, do not use Kima. Kima's initial app launch is U.S.-first; people outside the United States may use the website and waitlist unless we make the app available in their region.

2. What Kima Does

Kima helps households coordinate pet care by creating pet profiles, logging activities, managing tasks and reminders, sharing household updates, sending notifications, tracking streaks and achievements, and generating reports or insights based on user-entered care data.

Kima is a coordination and record-keeping tool. It is not a veterinary service, medical device, emergency service, or substitute for professional pet care.

3. Eligibility and Accounts

  • You must be at least 13 years old to create a Kima account.
  • If you are 13 to 17, you may use Kima only with permission from a parent or legal guardian. By creating an account, you confirm that your parent or legal guardian has reviewed and agreed to these Terms and our Privacy Policy and is responsible for your use of Kima.
  • You may not create an account for someone under 13 or help someone under 13 bypass Kima's age gate.
  • You must provide accurate account information and keep it current.
  • You are responsible for maintaining the confidentiality of your password and for activity under your account.

4. Household Sharing and Invites

Kima is built for shared households. Pet profiles, care logs, tasks, messages, notes, reports, and related household information may be visible to other household members according to their role. Only invite people who should have access to that household's pet care information.

You are responsible for invite links, deep links, shared pet links, shared activity links, and information you choose to share. Anyone with a valid link may be able to view or access the information made available through that link.

5. User Content and Data Accuracy

You retain ownership of pet photos, care logs, notes, messages, and other content you submit ("User Content"). You grant Kima a non-exclusive license to host, store, process, display, transmit, and use User Content as needed to provide, secure, support, and improve the Service.

Kima depends on information entered by you and your household. We do not verify medication dosages, feeding amounts, pet health notes, care schedules, or other user-entered data. You are responsible for checking accuracy before relying on any information in Kima.

6. No Veterinary Advice; AI Limitations

Kima does not provide veterinary advice, medical advice, diagnosis, treatment, medication guidance, emergency assistance, or professional care recommendations. Always consult a qualified veterinarian about your pet's health, medications, symptoms, emergencies, or treatment decisions.

Kima may offer AI-assisted insights, summaries, benchmarks, or reports based on user-entered data. AI output may be incomplete, inaccurate, delayed, or inappropriate for your pet. Do not rely on AI output as medical advice or as the sole basis for pet care decisions.

7. Notifications and Availability

Reminders, push notifications, emails, and app availability may be delayed, missed, inaccurate, or unavailable due to device settings, network conditions, app-store issues, third-party services, outages, maintenance, or user error. You should not rely solely on Kima for critical pet care timing, medication administration, or emergency situations.

8. Subscriptions and Payments

  • Kima may offer a free experience and paid Premium subscriptions through Apple App Store and Google Play in-app purchases.
  • Prices, renewal terms, taxes, and billing frequency are shown before purchase in the applicable app store purchase flow.
  • Subscriptions automatically renew unless canceled through your Apple App Store or Google Play account before the renewal deadline required by that store.
  • Kima cannot cancel a subscription on your behalf if the app store requires you to cancel through your store account.
  • Refunds are handled by Apple or Google according to their policies and applicable law. Kima may not be able to issue direct refunds for app-store purchases.
  • Premium features may be tied to a household, account, store entitlement, or RevenueCat customer identifier and may require an active entitlement check.

9. Ads and Third-Party Services

The free app experience may display ads through Google AdMob. Kima's launch configuration uses non-personalized ads by default. Ads and third-party links may lead to services we do not control, and your interactions with advertisers are between you and the advertiser.

Kima relies on third-party providers for hosting, storage, analytics, diagnostics, AI processing, subscriptions, app-store distribution, push notifications, email, and ads. We are not responsible for provider outages, failures, or terms except as required by law.

10. Acceptable Use

  • Do not use Kima unlawfully, abusively, deceptively, or in a way that harms users, pets, Kima, or the Service.
  • Do not upload, post, send, or share content that is unlawful, threatening, harassing, abusive, hateful, defamatory, sexually explicit, exploitative, graphic, deceptive, spammy, malicious, or otherwise harmful or objectionable.
  • Do not upload content you do not have the right to share or content that violates another person's privacy or rights.
  • Do not scrape, reverse engineer, attack, interfere with, or attempt unauthorized access to the Service.
  • Do not use Kima for emergency response, veterinary diagnosis, or any regulated medical/veterinary service.
  • Do not create accounts for children under 13 or misrepresent your age or identity.

11. Account Deletion and Termination

You may request account deletion in the app or by contacting us. Accounts enter a 30-day grace period before final deletion/anonymization, and you may reactivate during that period by logging back in. Some shared household records may remain for household integrity, legal, security, or business reasons, but we will remove or anonymize personal account data where supported.

We may suspend or terminate access if you violate these Terms, create risk, abuse the Service, or if continued access would be unlawful or harmful.

12. Intellectual Property

Kima, including its app, website, code, design, features, text, graphics, logos, and branding, is owned by Boticelli Ventures LLC or its licensors and protected by intellectual property laws. You may not copy, modify, sell, lease, or distribute any part of Kima except as allowed by these Terms.

Feedback or suggestions you send us may be used without restriction or compensation to you.

13. App Store Terms

If you download Kima from Apple App Store or Google Play, the applicable store terms also apply. Apple and Google are not responsible for providing support for Kima except as required by their own terms or applicable law. If these Terms conflict with mandatory app-store terms, the mandatory store terms control only for that conflict.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIMA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

Kima is not responsible for harm to pets, missed care, missed medications, missed reminders, inaccurate records, household misuse, data loss, service interruptions, third-party services, or decisions made based on user-entered or AI-generated information.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTICELLI VENTURES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PET INJURY, PET ILLNESS, OR PET DEATH ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIMA'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID KIMA IN THE 12 MONTHS BEFORE THE CLAIM OR $50.

16. Indemnification

You agree to defend, indemnify, and hold harmless Boticelli Ventures LLC and its officers, directors, employees, agents, and affiliates from claims, damages, losses, liabilities, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of another person's rights.

17. Governing Law and Disputes

These Terms are governed by Delaware law, without regard to conflict-of-law rules. Before filing a formal claim, you agree to contact info@getkima.com and try to resolve the dispute informally for 60 days.

Any unresolved dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court where allowed. You and Kima waive class, collective, consolidated, and representative proceedings to the maximum extent permitted by law.

18. Changes

We may update these Terms as Kima changes. If changes are material, we will post the updated Terms with a new date and may notify you in the app or by email. Continued use after the effective date means you accept the updated Terms.
